The H-1B work visa is a non-immigrant visa that allows you to work temporally in the United States. This type of visa is designed and issued for professional workers on specialized careers (accounting, computer analysts, programmers, database administrators, web designers, engineers, financial analysts, doctors, nurses, scientists, architects and lawyers).
H-1B visas are issued beneath a specific U.S. employer who filed the petition. H-1B visa allows its owner to work on a full or part-time job and to deal exclusively with that activity, which is described in the petition to the H-1B visa. Nevertheless, the visa holder may change the employer by the permission of USCIS.
H-1B work visa gives the right to reside and work in the U.S. on a permanent basis for a certain period of time (during the period of employment). One of the advantages of this work visa is that it is possible to change your worker visa status and apply for a Green Card through your employment in the United States. Conditions for obtaining H-1B visa
There are several conditions for obtaining the H-1B visa:
- the applicant must have at least a bachelor’s degree to work on the proposed work;
- the petition on the H-1B visa for the worker must be filed by the American sponsor (employer) six months before the actual date of commencement of the visa validity;
- the employer is responsible for the conditions that he offers, including wages, working conditions and benefits provided to the employee by a non-immigrant visa.
A foreign worker can continuously support the H-1B status within a maximum of six years. Those who wish to remain in the U.S. for more than 6 years, with a valid H1B visa, can apply for the permission for permanent residence (Green Card). Upon the expiry of the H-1B visa, the foreign worker must spend outside the United States at least a year, and only after that a new petition to the H-1B visa can be approved.
Since the demand for H-1B visas usually exceeds supply, USCIS limited periods of petition (usually the first week of April), and holds an annual lottery for the selection of petitions to the H-1B visa, suitable for adoption at the review.
The process of obtaining H-1B work visa
The process of obtaining the H-1B visa is not very complex, it can take from 2 to 6 months.
Includes: petition by the American sponsor, payment of applicable fees and passing the interview at the U.S.consulate. Once the petition was filed, the immigration forms were signed and conditions were agreed with the company, the Labor Department considers the Labor Condition Application (LCA) and determines whether the salary meets the requirements. Also, the Labour Department can conduct an audit of the company-employer to verify the veracity of the provided information. USCIS receives the immigration forms and determines whether the position corresponds to the requirements of H1B and whether the education and qualifications of the employee correspond this position. After approval from the Department of Labor and USCIS the employee must apply for a visa at the Embassy or U.S. Consulate. If the employee is already in the U.S. on any other visa, he/she must contact the Department of State for giving him H1B status.
Submission of applications is terminated in April.
What is H-2B visa?
If the candidate doesn’t have the required college education, he/she can apply for a H-2B Work Visa. To obtain the H2B visa, labor certification is required – an expensive and time-consuming process, which includes the promotion of the workplace and the persuasion the authorities that there are no American workers who can perform the work proposed for the immigrant. In addition, H-2B visas are issued initially for one year, renewable for up to three years, as opposed to the H-1B visa, which can be extended up to 6 years.
Other work visas
L-1 visa is a nonimmigrant visa, that can be obtained by the employess of subsidiaries of the American companies abroad, if they are transferred to work in the main office. Managers and senior staff may qualify for a visa under the code name L-1A, ordinary employees have the right to ask for L-1B visa. In order to get the L-1B visa you must work at least a year in a foreign subsidiary of a U.S. company.
Visas E-1 or E-2 permit to hire foreign executives, managers and other necessary staff. Entrepreneurs who conduct trading activities with U.S. companies may qualify for E-1 visa, and investors, in turn, for the E-2.
